Privacy Policy

Overview

Peleka LLC (a Wyoming limited liability company — “Peleka”, “we”, “us”) provides an email marketing platform. This policy explains what data we collect, why we collect it, and the choices you have. The short version: we collect only what we need to run the service, we never sell personal data, and your subscriber lists belong to you.

Two kinds of data, two roles

When we talk about privacy, it helps to separate two categories. Account data is information about you as a Peleka customer — your name, email, billing details. For this data, Peleka is the controller: we decide why and how it’s processed, and this policy governs it directly. Subscriber data is the contact information you import or collect from your own audience — your subscribers’ names, emails, and engagement history. For this data, you are the controller and Peleka is the processor: we handle it only on your instructions, under the terms of your agreement with us, to deliver the service to you. If you’re a subscriber on someone else’s Peleka list and have questions about how your data is used, the sender — not Peleka — is the right person to contact.

Data we collect

Account data — your name, email address, password (stored hashed, never in plain text), company details, and billing information when you create an account or subscribe to a paid plan.

Content data — the emails, templates, forms, landing pages, and automations you create in Peleka.

Subscriber data — contact information you import or collect through Peleka forms on behalf of your own audience, plus engagement signals (opens, clicks, bounces, unsubscribes) generated as we deliver your emails.

Usage data — how you interact with the product: pages visited, features used, and general performance data, collected so we can fix bugs and improve the service.

Device and log data — IP address, browser type, and device information, collected automatically for security and diagnostic purposes.

Integration data — if you connect a store (Shopify, WooCommerce) or other tool, we receive customer and order data to power segments and automations. Product details are looked up live from your store when needed (for example, inserting a product into an email) rather than stored on our servers. For Shopify and WooCommerce, this includes recording marketing consent when a customer opts in at checkout — the checkbox is opt-in and off by default, and a decline simply produces no record rather than a “declined” entry. If you connect a store, we may also correlate email engagement (opens and clicks) with your order data to provide revenue attribution reporting. See our integrations page for what each connection shares.

How we use data

We use data to operate and secure the service, deliver your emails, provide customer support, detect and prevent abuse or fraud, process payments, and comply with legal obligations. We also use aggregated, de-identified data to understand product usage and guide what we build next. We do not sell personal data to third parties, and we do not use your subscriber lists for anything other than delivering the service to you — we will never email your subscribers on our own behalf or share your list with another customer.

Legal basis for processing

If you’re in the EU/EEA or UK, we rely on the following legal bases: performing our contract with you (running the service you signed up for), our legitimate interests (securing the platform, preventing abuse, improving the product), your consent (for optional cookies and certain marketing communications), and legal obligation (tax and accounting records).

Cookies and tracking

This website doesn’t currently use cookies, analytics, or advertising trackers of any kind. If that changes, we’ll update this policy and, where required by law, ask for your consent first. Note that this doesn’t cover the Peleka product itself, which uses essential cookies to keep you logged in once you create an account.

How we share data

We share data with reputable third-party infrastructure, hosting, and email-delivery providers strictly to operate the service on our behalf, under contracts that require them to protect your data and use it only as we instruct. We share billing details with our payment processor to process transactions — Peleka does not store full card numbers. We may disclose data if required by law, to enforce our Terms of Service or Acceptable Use Policy, or in connection with a merger, acquisition, or sale of assets (with notice to you). A current list of subprocessors is available on request — email [email protected].

International transfers

Peleka is a US company, and data may be processed in the United States or other countries where our infrastructure providers operate. Where we transfer personal data out of the EU/EEA, UK, or Switzerland, we rely on recognized safeguards such as Standard Contractual Clauses.

Data retention

We retain account and subscriber data for as long as your account is active, plus a limited period afterward to allow for account recovery and to meet legal, tax, and accounting requirements. You can request deletion of your account and associated data at any time; some records may be retained longer where the law requires it.

Security

We use industry-standard safeguards — encryption in transit, access controls, and regular review of our systems — to protect your data. No method of transmission or storage is perfectly secure, and we can’t guarantee absolute security, but we work to keep your data protected and will notify you of any breach as required by law.

Your rights

You can export your contacts to CSV directly from your account at any time. If you need a complete export of your account data, email [email protected] and we’ll provide one. Depending on where you live, you may have the right to access, correct, delete, or port your personal data, to object to or restrict certain processing, and to withdraw consent where processing is based on consent. If you are in the EU/EEA or UK, these rights arise under the GDPR / UK GDPR. If you are a California resident, you have similar rights under the CCPA/CPRA, including the right to know what personal information we collect and to request deletion — and we do not sell or share personal information as those terms are defined under California law. To exercise any of these rights, email [email protected]; we’ll respond within the time required by applicable law. For more on how we support GDPR compliance, see our GDPR page and Data Processing Agreement.

Children’s privacy

Peleka is not directed at children, and we don’t knowingly collect personal data from anyone under 16. If you believe a child has provided us with personal data, contact us and we’ll delete it.

Changes to this policy

We may update this policy as our service or legal obligations change. If we make material changes, we’ll notify you by email or through the product before they take effect.
